The last meeting of the PLCOB was held on Monday, November 16, 2009.
It was reported that there were some questions on Senate Bill 1055 sponsored by Tommy Tomlinson, which has been referred to Professional Licensure Committee.
This bill has to do with proposed changes in the Cosmetology law that would require continuing education for 12 hours each 2 year period prior to renewal of a license. This would be 2 hours on communicable diseases, 2 hours on safety and sanitation, and 2 hours on laws and regulations. The other 6 hours are electives approved by the Board.
Will allow courses to be conducted in a classroom, internet, or home study. It requires courses to be provided by an approved provider. Establishes a $1,000. fee for providers and a $5.00 fee for each course to be paid by the Cosmetology Board. Nothing about what the provider can charge.
(It does not define the scope of study for the required courses, nor does it list acceptable elective classes. There are many unanswered question regarding this bill and there are a lot of things that are vague.)
It was reported about the strong possibility of Communit College of Alleghney County starting a Barbering program for the inner city of Pittsburg, where there is a need and strong interrest. Working together are Jane Greenwood, Dean of the Homewood Brushton Center and Wade Lipscomb, of Wade's Barbershop in Homewood. Mr Lipscomb is interested in working with the college to develop an affordable training program for the inner city barbers and new individuals who are considering barbering as a profession.
PA DOC continues to experience a sense of PCS not being sensitive and responsive to the needs of the scheduling of Barber and Cosmetology exams. In times of prison-over-crowding and budget restraintsd, dates and locations of exams are being dictated by PCS through the PA Board of Barber Examiners. The reviesw of the upcoming State contract /RFP/RFB has been requested to ensure wording is included to allow for Commonwealth of PA input into scheduling exams during the next contrsact period.

William Fraser, 2nd Vice President of Hair International, PA attended the spring meeting of the PLCOB in Harrisburg, PA on May 11, 2009.
John Bowerman was elected as Chairman for the Pennsylvania Legislative Council of Organized Barbers, (PLCOB) for the coming year.
John Christopher was elected as PLCOB Secretary as well.
The cosmetology schools representative reported that changes to Cosmetology Regulations have been finalized.
The corrections representative reported that they were considering switching to the State Teachers Union form the Corrections Officer Union.
The prison system has 16 schools and 4 shops for a total of 20 facilities.
William Fraser gave an up-date on the BARBER REGULATIONS.
The addition of § 3.71a requires the barbershop owner or owner's designee to notify the Board of each student to be trained in the shop, before the student begins training.
The amendments to § 3.72 requires barbershops to submit quarterly reports of student hours to the Board; clarify that the barbershop owner is responsible for keeping a student's records on file; and delete the requirement for barbershops to keep a student's blood tests on file.
The amendments to § 3.87 require barber schools to submit quarterly reports of student hours to the Board and delete the requirement for barber schools to keep a student's blood tests on file.
Pennsylvania's legislative year begins on December 1 and ends on November 30. One bill regarding us was passed. Several pieces of legislation were presented for consideration during this year and last.

HOUSE BILL 921 - Prime Sponsor: Representative CRUZ
An Act amending the act of June 19, 1931 (P.L.589, No.202), referred to as the Barber's License Law, further providing for licenses. This requires Barbers to have a photo ID as part of license.
HOUSE BILL 828 - Prime Sponsor: Representative READSHAW
An Act amending the act of October 27, 1955 (P.L.744, No.222), known as the Pennsylvania Human Relations Act, prohibiting certain practices of discrimination because of genetic information.

HOUSE BILL 299 - Prime Sponsor: Representative GOODMAN
An Act amending the act of July 2, 1993 (P.L.345, No.48), entitled "An act empowering the General Counsel or his designee to issue subpoenas for certain licensing board activities; providing for hearing examiners in the Bureau of Professional and Occupational Affairs; providing additional powers to the Commissioner of Professinal and Occupational Affairs; and further providing for civil penalties and license suspension", further providing for civil penalties; and making related repeals. (In English this means - Authorizes all 29 licensing boards within the Bureau of Professional and Occupational Affairs to impose the costs of investigation as part of a disciplinary sanction, and increases the maximum civil penalty to $10,000. for violations of the various practice acts.)

An Act amending the act of July 2, 1993 (P.L.345, No.48), entitled "An act empowering the General Counsel or his designee to issue subpoenas for certain licensing board activities; providing for hearing examiners on the Bureau of Professional and Occupational Affairs; providing additional powers to the Commissioner of Professional and Occupational Affairs; and further providing for civil penalties and license suspension", further providing for civil penalties; providing for confidentiality of information; and making related repeals. (Same as HB299 but also makes the 29 licensing boards' investigation file confidential.) THIS PASSED IN JULY AND IS NOW ACT 25 OF 2009.

HOUSE BILL 918 - Prime Sponsor: Representative CRUZ
An Act amending the act of May 3, 1933 (P.L.242, No.86), referred to as the Cosmetology Law, further providing for display of licenses. (Requires the holder of a license issued by the Cosmetology Board to show a state-issued phote ID at the time of inspection.)
HOUSE BILL 1295 - Prime Sponsor: Representative GIBBONS
An Act amending the act of May 3, 1933 (P.L.242, No.86), referred to as the Cosmetology Law, further providing for booth rental prohibited. (Prohibits booth rental in cosmetology salons. NOTE: This is currently prohibited by regulation.)
SENATE BILL 1055 - Prime Sponsor: Senator TOMLINSON
An Act amending the act of May 3, 1933 (P.L.242, No,86), referred to as the Cosmetology Law, providing for continuing education. (Requires all Cosmetology Board licensees to complete 12 hours of continuing education per biannual license period.)
